Abstract

В контексті збройної агресії виникає кілька додаткових питань. Першим є примусові шлюби військових з жінками з окупованих територій, в умовах збройної агресії. Ні про одношлюбність, ні про добровільність тут говорити не можна. Другим є випадок, коли процедура реєстрації шлюбу в умовах воєнних дій недоступна. Сімейний кодекс України в таких випадках дозволяє визнавати законним шлюб, зареєстрований відповідно до релігійної церемонії. Однак при цьому дотримання засад добровільності та одношлюбності по суті залишається відповідальністю наречених, бо священник не може перевірити достовірність таких даних.
