Заборона пропаганди війни у сучасному міжнародному праві

Abstract

У сучасному світі пропаганда війни має суттєвий вплив на мир і безпеку людства, і наразі важко припустити, що в майбутньому її використання зменшиться. Пропаганда війни, як злочин, є надзвичайно складним феноменом для точної кваліфікації форм протиправної поведінки, оскільки їй притаманна невизначеність та інколи скрита природа негативних наслідків. У науковій літературі сформовано доволі дискусійний спектр уявлень про сутність пропаганди загалом і пропаганди війни зокрема. Одна з причин дискусійності цього феномена полягає в його багатовекторності та правовій невизначеності як в національному, так і в міжнародному праві, адже насьогодні немає узгодженого визначення терміна «пропаганда», зокрема «пропаганда війни». Заборона пропаганди війни та протидія їй є важливими напрямами діяльності міжнародних інституцій у сфері дотримання прав людини, забезпечення верховенства права. Між тим, у Римському статуті МКС відсутній такий склад злочину, як пропаганда війни, а тому вважливо довести, що пряме та публічне підбурювання до агресії чи пропаганда війни мають бути внесені до нього. Проблематика з’ясування феномена пропаганди війни стає ще більш значущою з огляду на появу, поряд із традиційними, новітніх форм ведення воєнних дій. Тому для правової науки та міжнародної практики вкрай важливо з’ясувати розуміння ключових аспектів пропаганди війни. Необхідне вироблення єдиного понятійного апарата цього явища, визначення змістовного наповнення пропаганди війни та її структурних елементів.

In today's world, the propaganda of war has a significant impact on the peace and security of mankind, and it is difficult to imagine that its use will decrease in the future. Propaganda of war, as a crime, is an extremely difficult phenomenon for precise qualification of forms of illegal behavior, because of its inherent uncertainty and sometimes hidden nature of negative consequences. In the scientific literature, a rather debatable spectrum of ideas about the essence of propaganda in general and war propaganda in particular has been formed. One of the reasons for the controversy of this phenomenon lies in its multi-vector nature and legal uncertainty in both national and international law, because today there is no agreed definition of the term "propaganda", in particular "war propaganda". Prohibition of war propaganda and countering it are important areas of activity of international institutions in the field of human rights observance and ensuring the rule of law. Meanwhile, the Rome Statute of the International Criminal Court does not include such a crime as propaganda for war, and therefore it is important to prove that that direct and public incitement to aggression or propaganda of war should be included in it. The problem of clarifying the phenomenon of war propaganda becomes even more significant in view of the emergence, along with the traditional, of the newest forms of conducting military operations. Therefore, it is extremely important for legal science and international practice to clarify the understanding of the key aspects of war propaganda. It is necessary to develop a unified conceptual apparatus of this phenomenon, to determine the content of war propaganda and its structural elements.
